Breaking: PBIS Releases Free Division 296 Exposure Calculator For SMSF Strategy Implementation

Division 296 has quickly become the central issue in the SMSF and superannuation market. It is shaping legislative discussion, technical strategy, CPD agendas, and client sentiment across the profession. For accounting firms, this is not simply another policy development. Division 296 Tax – The New Superannuation Earnings Tax From 1 July 2026, Division 296 introduces an additional tax on superannuation earnings for individuals with a high Total Super Balance (TSB). It applies where consolidated TSB across all super funds exceeds $3 million as at 30 June 2027 (the first measurement date).

The tax works on a proportional basis:
15% additional tax (bringing the effective rate to 30%) on the portion of net super earnings attributable to the balance between $3 million and $10 million.
Further 10% additional tax (bringing the effective rate to 40%) on the portion of earnings attributable to the balance above $10 million.

This is an earnings-based tax (not on contributions or the balance itself), calculated using SMSF’s realised earnings and attributed proportionally to the excess balance. The tax is assessed personally, although the SMSF may elect to pay the liability on trustee(s) behalf.
